The system of personal residential loan was established in our country in the late 1980s, which has developed greatly in more than a decade. The loan collected in advance for commodity houses has a large share in the total loans released by the bank. Through analyzing some corresponding laws in the advance sale of the commodity houses, this paper points out the legal status of the bank and risks it undertakes, and accordingly some precaution measures are designed to deal with these problems.
